Patty Shwartz, who was nominated to the U.S. Court of Appeals for the Third Circuit in October 2011, won’t receive a confirmation vote in the 112th Congress.
Shwartz, a magistrate judge in the District of New Jersey, was nominated by President Obama to fill the seat left open in June 2011 when U.S. Court of Appeals Judge Maryanne Trump Barry took senior status.
Having been on the Senate calendar for months, Shwartz’s confirmation won’t be voted upon before the new Congress convenes January 3, according to a Senate aide.
At the end of last month, the senate confirmed two judges for Pennsylvania’s Middle District, which had had those seats empty for years. The month before that, the Senate confirmed three judges for Pennsylvania’s Eastern District. There are three more vacancies in the Eastern District.
